State rules do not require a written personal services contract if compensation for the services provided by the family member was made within 60 days after the services were provided. This is an exception to the written personal services contract.
To satisfy this requirement, the care provider must submit monthly billings at the end of each month to the person responsible for payment covering services provided during the previous month, and the billings must be paid within 60 days of the date of the first service covered by the billing.
It is important for family members to keep good records of the bills and payment. Everything should be in writing. The parties must follow the plan to make sure they have timely payments for care.
